The rules that bind us

By accessing or using any Nyuki AI service — including our mobile application, web dashboard, and pharmacy staff tablet interface (collectively, the "Platform") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform.

These Terms form a binding agreement between you and Nyuki AI Technologies ("Nyuki AI", "we", "us"). If you are using the Platform on behalf of a business (e.g. a pharmacy), you represent that you have authority to bind that business to these Terms.

Nyuki AI provides:

• ›AI-powered skin diagnostic tools for end consumers via mobile app
• ›Personalised skincare routine recommendations based on AI analysis
• ›A loyalty programme (Nyuki Club) with points, tiers, and QR Pass
• ›Pharmacy management tools: inventory tracking, stock management, purchase orders
• ›A master product catalogue and per-pharmacy product management
• ›Business analytics, KPI dashboards, and reporting for pharmacy owners
• ›Sales staff training modules and client relationship tools

We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

• ›You must provide accurate, complete, and current information when registering
• ›You are responsible for maintaining the confidentiality of your credentials
• ›You must notify us immediately if you suspect unauthorised access to your account
• ›Each user account is personal and non-transferable
• ›Pharmacy accounts must be created by the pharmacy owner or an authorised manager
• ›We reserve the right to suspend accounts that violate these Terms

You agree not to:

• ›Use the Platform for any unlawful purpose or in violation of applicable Cameroonian law
• ›Upload images of individuals other than yourself without their explicit consent
• ›Attempt to reverse-engineer, decompile, or extract the source code of any part of the Platform
• ›Use automated scripts, bots, or scrapers to access the Platform
• ›Misrepresent your identity or affiliation with any person or organisation
• ›Introduce malware, viruses, or any code intended to damage or disrupt the Platform
• ›Resell or commercialise Platform data or outputs without written authorisation from Nyuki AI

Our AI diagnostics are designed to assist parapharmacy staff in making product recommendations. They should not be used to diagnose, treat, or manage any medical condition. Always consult a qualified healthcare professional for medical concerns.

By using the diagnostic features, you acknowledge and accept that AI analysis may be imperfect and that Nyuki AI is not liable for decisions made solely on the basis of AI-generated results.

All Platform content, including but not limited to software, design, text, graphics, AI models, and the Nyuki AI brand, is the exclusive property of Nyuki AI Technologies or its licensors and is protected by intellectual property laws.

You retain ownership of content you upload (e.g. your skin images and profile data). By uploading content, you grant Nyuki AI a limited, non-exclusive licence to process and store that content solely to provide the Platform services.

You may not use Nyuki AI's name, logo, or brand without prior written consent.

The Platform integrates third-party services including AI providers (OpenRouter, Anthropic), cloud storage (Contabo), push notifications (Expo), and email (IONOS). Your use of these services is subject to their respective terms and privacy policies.

Nyuki AI is not responsible for the availability, accuracy, or conduct of third-party services.

To the maximum extent permitted by applicable law, Nyuki AI Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business interruption — arising from your use of or inability to use the Platform.

Our total cumulative liability for any claim arising from these Terms shall not exceed the amount you paid to Nyuki AI in the twelve months preceding the claim, or XAF 50,000 if no payment was made.

You may terminate your account at any time by contacting us at legal@nyukiai.com. Upon termination, your data will be handled as described in our Privacy Policy.

We may terminate or suspend your access immediately, without notice, if you breach these Terms or if we determine in good faith that your use poses a risk to other users or the integrity of the Platform.

These Terms are governed by the laws of the Republic of Cameroon. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Douala, Cameroon, unless otherwise required by applicable consumer protection law.

We may update these Terms from time to time. When we make material changes, we will notify you via email or in-app notice at least 14 days before the change takes effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
